Terms of Service

These Terms of Service ("Terms") govern your access to and use of Quosel (the "Service"), a tool for building, sharing, and publishing websites for local businesses. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are

The Service is operated by Daniel Jiménez Rivera, based in Spain ("Quosel", "we", "us"). For any questions about these Terms you can reach us at hello@quosel.com.

2. The Service

Quosel lets you start from a template, generate website copy with AI, upload images, share a public link so your client can review and edit the copy in real time, and publish the finished site to a custom domain. Features may change, improve, or be discontinued over time.

3. Eligibility and accounts

You must be at least 18 years old and able to enter into a binding contract to use the Service. You may sign in using a third-party provider (such as Google). You are responsible for activity under your account and for keeping your access credentials secure. Notify us promptly of any unauthorised use.

4. Plans, billing and cancellation

  • The Service offers a free tier (your first 3 sites) and a paid plan (Pro) billed monthly.
  • Payments are processed by our payment provider, Stripe. We do not store your full card details.
  • Paid plans renew automatically each billing period until cancelled. Prices are shown exclusive or inclusive of taxes as indicated at checkout.
  • You can cancel at any time; cancellation takes effect at the end of the current billing period.
  • Except where required by applicable law (including statutory consumer withdrawal rights), payments are non-refundable. Nothing in these Terms limits your mandatory rights as a consumer under Spanish and EU law.

5. Your content

You retain ownership of the text, images, business information, and other materials you add to the Service ("Your Content"). You grant us a worldwide, non-exclusive licence to host, store, process, reproduce, and display Your Content solely to operate and provide the Service, including publishing sites you choose to publish.

You are responsible for Your Content and confirm that you have the rights and permissions needed to use it — including any images, logos, and information relating to a third party or client. You must not upload or publish content that is unlawful, infringing, misleading, or that violates the rights or privacy of others.

6. AI-generated content

The Service uses AI to draft website copy from the business details you provide. AI output may be inaccurate, incomplete, or unsuitable, and is provided as a starting point only. You are responsible for reviewing, editing, and verifying any AI-generated content before publishing it.

7. Acceptable use

You agree not to misuse the Service. In particular, you must not:

  • use the Service for any unlawful, fraudulent, or harmful purpose;
  • infringe intellectual property or privacy rights;
  • attempt to disrupt, reverse engineer, or gain unauthorised access to the Service or its systems;
  • resell or misrepresent the Service in a way that breaches these Terms.

8. Publishing and custom domains

When you publish a site you are responsible for ensuring you have the right to use any connected domain and for configuring it correctly. We may suspend or remove published content that breaches these Terms or applicable law.

9. Third-party services

The Service relies on third-party providers (for example Google sign-in, Stripe for payments, and our hosting and infrastructure providers). Your use of those features may also be subject to the relevant third party's terms, and we are not responsible for third-party services.

10. Intellectual property

The Service, including its software, templates, design, and branding, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not transfer any of those rights to you beyond the limited right to use the Service.

11. Availability and disclaimer

The Service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. We do not guarantee that the Service will be uninterrupted, error-free, or that AI output will be accurate.

12. Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, or consequential damages, or for loss of profits, data, or goodwill arising from your use of the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including your mandatory consumer rights.

13. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or where required by law. On termination, the rights granted to you under these Terms will end.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing law

These Terms are governed by the laws of Spain. Any disputes will be subject to the competent courts, without prejudice to any mandatory rights you have as a consumer to bring proceedings in your place of residence.
